Abuse and neglect of some of our society’s most vulnerable citizens is a situation that I take very seriously. Unfortunately, the isolation and the physical and mental conditions of many nursing home residents often make them vulnerable to neglect or abuse.

If a nursing home resident you know has sustained injuries, the Illinois nursing home law known as the Illinois’ Nursing Home Care Act provides a way to claim compensation for:

  • medical expenses;
  • pain and suffering;
  • disability;
  • disfigurement; and
  • aggravations of pre-existing conditions.

This compensation can be used to move the resident to a higher-quality facility where his or her needs will be better addressed. In cases where the abuse or neglect caused the resident’s death, any compensation won would go to his or her next of kin for the wrongful death of their family member.

Finally, it is important for you to know that you have a limited amount of time to open a nursing home abuse or neglect case, according to Illinois nursing home law. The statute of limitations for these cases is normally 2 years but if a public entity operates the home, you only have 1 year.
